The following terms & conditions govern the rights and obligation of B Fitness Asia Sdn. Bhd. (1204067-X), its subsidiaries and affiliates including BossFit operating under the Babel brand (collectively known as "The Babel Group") and members thereof. These T&C shall apply to your conduct within BossFit's premises, which include its fitness centres, studios, all outdoor areas, parking lots, sidewalks and all other premises within the ownership or licensed control of BossFit (collectively known as "Premises"). They also apply to your conduct during its programmes, training, events or other activities off the Premises involving BossFit (collectively known as "Events").

By agreeing to these Terms & Conditions, you acknowledge that you have read, understood and agreed to both the Terms and Conditions and the Privacy Policy, and expressly consent to our collection, use and disclosure of your personal information as described in the Privacy Policy.

Membership

  • Membership is personal to the individual signed up and is non-assignable, non-refundable and non-transferable.

  • The Management reserves the right to reject any membership application of the Club for any reason whatsoever.

  • Monthly Members are required to pay the fee specified at the time of registration.

  • Joining Fees and Membership Fees are NOT refundable upon termination of membership for any reason whatsoever.

Membership fees, joining fees, and personal training session fees are non-refundable under any circumstances, except where mandated by law.


This includes, but is not limited to:

  1. Member termination for any reason;

  2. Unused personal training sessions; or

Refund requests are only considered in cases of billing errors or as required by law. All requests must be submitted in writing to hai@boss.fit and are subject to management approval.

  • The Member must email hai@boss.fit to freeze his/her membership at least seven (7) days prior to the desired freeze start date, with a MINIMUM term of one (1) month.

  • Freezing fees will be charged at RM50.00 per month.

  • NO BACKDATED freezing will be allowed. All freeze requests MUST be emailed seven (7) days prior to the freezing start date.

  • The Membership will be reactivated automatically after the freezing period, unless a freeze extension is requested via hai@boss.fit.

  • Members who purchase the 1 Month membership are not eligible for any freezing.

  • The freezing request date can start from any date and members are unable to access the gym during the freezing period.

  • For the avoidance of doubt, PT sessions expire based on the purchased package terms (e.g., 1 month or 3 months). Freezing requests for PT sessions must align with the membership freezing policy, requiring a minimum one-month freeze and a 7-day notice via email.

  • Any early cancellation will result in a one-time RM350.00 termination fee payable prior to a confirmed termination. All memberships are subject to auto-renewal and will not be automatically cancelled upon completion of the membership contract.

  • The Babel Group reserves the exclusive right, at its sole discretion, to terminate the membership of any individual and restrict or prohibit their future access to BossFit's facilities and services, if the member is found to have violated BossFit's policies or the T&C herein, or if their conduct is deemed unlawful, unethical, or detrimental to the safety, reputation, or operational integrity of BossFit.

  • Grounds for termination include, but are not limited to, acts of misconduct, harassment, non-payment of fees, unauthorised use of proprietary materials, or any behaviour that contravenes applicable laws, regulations and/or BossFit policies.

  • The Member must email hai@boss.fit to cancel his/her membership stating the reason for cancellation.

  • Cancellation requests must be made at least seven (7) days prior to the next billing date.

  • All personal training sessions purchased by Members are subject to the T&C outlined herein, as well as the Personal Training Agreement, which must be signed separately at the time of purchasing PT packages.

  • BossFit Fitness Instructors/Trainers are not licensed medical professionals and are without expertise to diagnose medical conditions or impairments. The Member agrees to promptly and fully disclose any injury, condition or impairment which may have a deleterious effect on or be impacted by the personal training program.

  • The Fitness Instructor/Trainer is entitled to discontinue training in the event of the discovery of any condition which presents or is likely to present adverse risks or threats to the health or safety of the member, the Fitness Instructor/Trainer and/or others.

  • The fee for personal training services is payable in advance in one lump sum at least three (3) days prior to the scheduled session. Payments should be made at the Customer Service Counter or via the Babel App. The member will not be allowed to pay the Fitness Instructor/Trainer directly for a session.

  • All sessions possess an 'End Date' or 'Expiration Date'. In the event that the purchased Personal Training Package is not fully utilised prior to the Expiration Date, any and all remaining sessions shall be deemed forfeited.

  • The time of sessions is to be agreed upon between the trainer and the member. You must arrive on time for the scheduled appointment. If you arrive late, your session will end at the originally scheduled time.

  • The member must give a twenty-four (24) hour cancellation notice for rescheduling or cancelling any Session. Failure to do so will result in forfeiture of the session and no payment reimbursement will be granted.

  • Any tardiness of more than 15 minutes or absence without proper notification will result in the forfeiture of the session and no reimbursements will be granted.

  • In the event that the assigned Fitness Instructor/Trainer cancels the session within the 24-hour notice period, BossFit shall ensure that a substitute Fitness Instructor/Trainer of the same Tier is provided for the affected session(s).

  • Upon providing substantiated and reasonable grounds for dissatisfaction, the member may request a different Fitness Instructor/Trainer of the same tier, subject to BossFit's discretion and availability.

  • All personal training package fees are non-refundable, irrespective of whether the member is unable or fails to complete sessions. There shall be no refund of any monies paid to BossFit in any event whatsoever.

  • You are responsible to verify every session with the Fitness Instructor/Trainer by signing a Confirmation of Conducted Personal Training Sessions form (COC).

  • BossFit reserves the right to assign a different Fitness Instructor/Trainer to you at any time without prior notice.

  • Individual results may vary due to several factors including body type, nutrition, lifestyle, and adherence to the training program. No specific results, outcomes, or timelines are guaranteed.

  • Proper nutrition and adequate rest are essential to this training program. Members must not be under the influence of drugs or alcohol at any time during a training session.

  • During each session you are required to wear appropriate athletic footwear and comfortable clothing. BossFit reserves the right to deny commencement of the session should the attire be deemed inappropriate.

  • Members are strictly prohibited from bringing guests or any unauthorised individuals to the sessions unless prior written approval has been granted by BossFit.

  • The Member agrees not to solicit, engage, or hire the Fitness Instructor/Trainer for private training sessions outside of BossFit without prior written approval from BossFit. Any breach of this clause shall result in immediate termination of the Member's contract without any refunds.

  • The Fitness Instructor/Trainer shall not be held liable for any injury, illness, or damage arising from participation in any personal training session, except where directly attributable to gross negligence or wilful misconduct on the part of the Fitness Instructor/Trainer.

  • All personal training sessions purchased by Members are subject to the T&C outlined herein, as well as the Personal Training Agreement, which must be signed separately at the time of purchasing PT packages.

  • Members are required to arrive at least 10 minutes before the scheduled start time of their class. The doors to the class will be locked 5 minutes after the class begins, and latecomers will not be allowed entry to avoid disrupting the session.

  • Filming or photography in the changing room area is strictly prohibited. Violations may result in immediate termination of membership.

  • Members must adhere to all posted signages and wear appropriate workout attire. The management reserves the right to deny entry if attire is deemed inappropriate.

  • Members should be respectful of others by not hogging machines or occupying spaces unnecessarily.

  • Filming or photographing other members without their consent is strictly prohibited.

  • No food is allowed on the gym floor or in workout areas. Food may only be consumed in the lounge or café area.
